The ‘COOKmate‘ - formely ‘My CookBook’ Service is provided by the MAADINFO SERVICES company, a ‘Société à Responsabilité Limitée’ [limited company] with a capital of 5,000 Euros, having a ‘siège social’ [registered office] situated at 2 allée des Ormeaux, GRASSE (06130) (France).

By using this Service, the User acknowledges that they have read and accepted, with no reservations of any kind, all the provisions of these Terms and Conditions.

These Terms and Conditions (‘Conditions’) form the contract made between MAADINFO SERVICES (‘MAADINFO SERVICES’, ‘we’, or ‘us’) and you (‘you’, ‘your’, ‘User’ or ‘Users’).

These Conditions can be modified at any time by MAADINFO SERVICES in order to be able to continue to provide the Service in an appropriate and optimum manner. The User also agrees to be bound by the said modifications. We therefore advise you to regularly review and accept these Conditions on (https://www.cookmate.online/cgv).

Services

‘COOKmate‘ enables you to import, organize, and optimize content you have found by offering you search tools, the ability to filter content from specific sources, and then to reorganize this content into an online recipe book that groups all the imported content together. For more details about the Service and its functioning, please see our support pages.

The ‘Website’ consists of the website COOKmate (www.cookmate.online).

The ‘Android applications’ consist of the applications COOKmate - My recipe organizer and COOKmate Pro (Ad Free).

The ‘iOS applications’ consist of the applications Cookmate - My Recipe Organizer and My CookBook (Recipe Manager).

The ‘Alexa skill’ consists of the skill Cookmate - formerly My CookBook.

The ‘Google action’ consists of the action Cook mate.

The ‘Content’ is defined as all information, text, graphics, links (URLs), images, videos, sounds, and any uploaded or downloaded material that appears on or is extracted from the Service.

The ‘Third Party Service’ relates to any services other than that mentioned above and which provides content.

The Service displays the Content as determined by the following elements:
  • a) Content selected or extracted from Third Party Services in accordance with your selection criteria and displayed by COOKmate.
  • b) Any other Content provided by COOKmate. The Service determines the position and layout of this Content.

You access the Service under the following conditions:

Access

Subject to these Terms and conditions, we offer you access to the Service for personal use and not for professional use to the benefit of third parties. In addition you agree to make use of the Service within the law whether such law is local, national or international

You are aware that the Service may involve the use of streams, links, content and other data originating from Third Parties. Any use of such data is governed by the specific Terms and Conditions of those Third Parties, under the sole responsibility of the User.

Modifications and Availability of the Service

The COOKmate Service is constantly evolving and its features may change periodically without prior notice.

COOKmate may change or interrupt all or part of the Service without having to provide reasons, in particular the availability and accessibility of the Service as a whole or of any feature, Content or Third Party Service. COOKmate may be required to carry out such interruptions, either temporarily or permanently, without giving you prior notice and cannot be held liable in any way or be required to offer any kind of compensation by the User.

COOKmate will make every reasonable effort necessary to ensure the availability of the Service 24 hours a day and 7 days a week. Nevertheless, it is possible that the Service may be interrupted in the event of updating of its software or for a reason beyond its control, such as the unavailability of Third Party Services for example, or generally any insurmountable event or force majeure. COOKmate cannot be held responsible for such interruptions and the User cannot pursue any claim for damages that the interruption to the Service may have caused.

Registration/Membership

Before you can use the Service, it is possible that you will be required to register by providing certain information, including information that Third Party Services require to be able to offer you their services. When registering, you must provide correct, legal, and verifiable information. We reserve the right to refuse, without justification, any registration request and to delete, without having to provide justification, any registration already made.

You agree not to use the information or accounts of other users to access COOKmate without formal authorization to do so.

Third Party Services

COOKmate incorporates links to content put online by Third Party Services, including information that you or their users have shared. COOKmate cannot be held responsible for such content. All content incorporated, displayed, posted or extracted, is the sole responsibility of the User and/or the responsibility of the users who originally selected said content.

COOKmate has no control over content generated by Third Party Services, and cannot be held in any way responsible for the said content, its continued display or typology.

The User irrevocably waives the right to any claim against the Service or the Content of the Third Party Services, or applications. The User acknowledges and accepts that, in addition to these conditions, all use of these Third Party Services should be made in accordance with their own specific terms and conditions.

Intellectual property and other rights

All rights in relation to the Service (with the exception of content provided by Users) are and will remain the exclusive property of COOKmate. The Service is legally protected. Nothing in these Conditions gives the right to use the name of COOKmate or of MAADINFO SERVICES, its logos, domain names and other distinctive identifiers of COOKmate .

All comments, observations or suggestions that the User provides about the Service are entirely voluntary and MAADINFO SERVICES remains free to use such feedback, comments, and suggestions on its own initiative, and without any obligation in relation to the User.

All other brands mentioned on the Website or in the Service are and will remain the property of their respective owners.

Usage of the service – Authorizations and restrictions

MAADINFO SERVICES reserves the right at all times (but has no obligation) to delete or to refuse to distribute any Content from its Service and to delete User accounts. MAADINFO SERVICES also reserves the right to access, read, store and divulge any information deemed necessary to: (i) comply with laws, regulations, and legal procedures or requirements, (ii) apply the Terms and Conditions, including enquiries into possible violations of these Conditions, (iii) detect, prevent, or deal with fraud, security or technical problems, (iv) respond to Users’ requests for assistance, or (v) protect the rights, property or security of COOKmate, its Users, or the general public.

In order to guarantee that the content distributed in the Service is safe and legal, you agree not to provide or to encourage the provision of content and information that, in particular could be deemed to be:
  • a. Violent or an infringement of the copyright of authors, brands, or any other intellectual property right over which you have no rights.
  • b. Containing a virus or any other computer software designed to damage, harm, or expropriate any system, data, or information.

MAADINFO SERVICES can delete any content, at any time, without having to provide a reason for its actions.

Features, Prices and Billing

The Website COOKmate Online offers two types of accounts:
Free Accounts
  • Limited to sixty (60) recipes
  • Limited to one (1) shopping list
  • Limited to one (1) import of a URL per day
  • With advertising
Premium Account
  • Unlimited number of recipes (*)
  • Unlimited number of shopping lists (*)
  • Unlimited number of imports
  • Without advertising
  • A feature enabling you to recalculate the ingredients of your recipes
  • A feature enabling you to add recipe ingredients to a shopping list

  (*) For security reasons, the Premium account is currently limited to 20000 recipes and 10000 shopping lists. If you need more, please contact us.


Price including taxes: 1.99 USD or 1.99 Euros for one month, 6 Euros or 6 USD for three months or 20 Euros or 20 USD for a year

When the User opens a COOKmate Online Premium account, he/she agrees to pay all costs and charges, including any applicable taxes, at the moment they become due.

All prices shown are in USD or Euros.

COOKmate Online may add other products and features at any time and at its own convenience. Naturally, the User is free to subscribe (or not) to these new products and features.

The User confirms that he/she is authorized to use the payment method that he/she has chosen on the system. HE/SHE CERTIFIES AND CONFIRMS THAT HE/SHE IS FULLY RESPONSIBLE FOR ANY FINANCIAL COMMITMENTS, PAYMENTS OF COSTS AND CHARGES BILLED BY COOKMATE ONLINE IN THE CONTEXT OF HIS/HER SUBSCRIPTION TO A 'PREMIUM' ACCOUNT.

Subscriptions to COOKmate Online Premium accounts are payable in advance and no refunds are given for any reason whatsoever.

No refunds are given for partially unused subscriptions on a pro rata basis nor shall credits be given for such periods.

Upon expiry of the COOKmate Online Premium account, the User will be transferred to a free account with its associated limitations. The recipes and shopping lists that exceed these limits will not be deleted but may no longer be accessible. The User will be able to access them again by renewing his/her subscription.

Free features
It is possible to increase the number of recipes and shopping lists free of charge by the following methods:
  • Invitation/sponsorship of one (1) to five (5) friends to register on COOKmate Online: 5 recipes and 1 shopping list per friend.

Security

We are concerned for our Users’ security. Although we make every effort to preserve the security of your content and your account, MAADINFO SERVICES cannot guarantee that unauthorized third parties will not be able to breach our security precautions. Please inform us immediately of any unauthorized use or unauthorized attempt to access your account.

Disclaimer

In general, the User acknowledges that use of the Service is made under his/her own responsibility.

Because the Service contains links to third party websites, advertisers, services, special offers, or other events, or activities that are not owned or organized by MAADINFO SERVICES, we do not recommend or take any responsibility for such third party websites, information, resources, products, or services.

When you access a third party website, service or content from COOKmate, you are doing so at your own risk and you accept that MAADINFO SERVICES does not assume any liability arising from your use of, or access to any third party website, service, or content.

MAADINFO SERVICES AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR SPECIAL DAMAGES, RESULTING FROM (i) YOUR ACCESS TO, OR USE OF, OR INABILITY TO USE, OR ACCESS SERVICES, (ii) ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING BUT NOT LIMITED TO, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT BY OTHER USERS OR BY THIRD PARTIES, (iii) ANY CONTENT ORIGINATING FROM DIFFERENT SERVICES, AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF COMMUNICATIONS OR THEIR CONTENT.

Cancellation

Any of the parties may cancel the Services at any time. MAADINFO SERVICES can cancel or suspend your access to the Service at any time, without prior notice or liability, if you do not abide by the terms and conditions of use. In the event of cancellation, your right to use or access the Service will cease immediately. All provisions of these Conditions which, by their nature, survive the cancellation and will be applicable, including, without restriction, the intellectual property provisions, warranty disclaimers and limitations on liability.

Applicable law

These Terms and Conditions are governed by French law and interpreted in accordance with French legislation.

All claims, legal proceedings or litigation arising out of or relating to these Conditions shall be subject to the competent courts on French territory.

Miscellaneous

These Conditions constitute the entire and exclusive agreement between MAADINFO SERVICES and its Users regarding the COOKmate Service. For this reason, they annul and replace any prior agreement.

The COOKmate Online website https://www.cookmate.online (contact: contact@cookmate.online) is owned by the MAADINFO SERVICES Company, Societé à Responsabilité Limitée [limited company] with a capital of 5,000 Euros.
